Charges against a former North Dakota man who was at the U.S. Capitol during the riot on January 6, 2021, have been dropped.

Damian Johnston agreed to plead guilty last year to two misdemeanor counts, disorderly and disruptive behavior in a Capitol building or grounds, and parading, protesting, or picketing in a Capitol building.

Court records from Washington, D.C. show that the charges against Johnston have been dropped due to the general pardons given by President Donald Trump on Monday to nearly all January 6 defendants.

Johnston, who used to be the vice chair of the North Dakota Young Republicans, shared on X that his lawyer told him he has been pardoned.

“It’s done!” “I got my rights back!” Johnston added this in his post.

He was supposed to be convicted in February.

Court records show that Johnston now lives in Wisconsin.

His father, state Rep. Daniel Johnston, R-Kathryn, said on Monday that he feels happy his son can still walk freely in the streets.

“We don’t have a two-tier justice system anymore,” Rep. Johnston said to the North Dakota Monitor. “It’s a fresh start for America.”

Daniel Johnston said his son was caught up in a crowd at the Capitol but listened to the cops.

Trump’s order only names 14 people who were pardoned, not the entire list. It calls for a total and unconditional pardon for everyone convicted of crimes linked to the events at or near the United States Capitol on January 6, 2021.

Two other guys connected to North Dakota were charged for their involvement in the January 6, 2021, riot.

Rockne Earles from Oriska was charged with assaulting an officer at the Capitol, based on records from the Department of Justice.

Eric Zeis, who says on his Facebook page that he is from Fargo, broke into the Capitol, according to documents from the Department of Justice.
