Denver Public Schools Take Legal Action Against Trump’s ICE Policy in Schools

Denver Public Schools made history on Wednesday by becoming the first school system in the United States to file a lawsuit against the Trump administration, contesting its policy of permitting immigration officials to be present in schools.

A federal lawsuit was filed by the largest public school district in Colorado, which contended that the policy has resulted in a significant decrease in student attendance and has forced schools to redirect essential educational resources.

The lawsuit says that the Department of Public Safety (DPS) is unable to accomplish its goal of providing education and life services to kids who are avoiding attending DPS schools out of concern that immigration enforcement operations may take place on DPS school grounds.

Additionally, the Trump administration has not presented a “good reason” for rescinding the standards, nor has it fully evaluated or handled the impact, according to the federal lawsuit that has been filed against the Department of Homeland Security and Secretary Kristi Noem of the Department of Homeland Security.

The long-standing regulations that restricted immigration enforcement near sensitive sites, such as schools, were abolished by President Donald Trump a month ago.

At the same time that the news was made, the newly elected president is working to fulfill his campaign vows to carry out mass deportations.

“Denver is standing up for its children and families and protecting the right of all children, regardless of their immigration status, to attend public schools,” said Elora Mukherjee, director of the Immigrants’ Rights Clinic at Columbia Law School, in an email. “Denver is protecting the entitlement of all children to attend public schools.”

According to the lawsuit, which cites data from the 2023-2024 school year, Denver Public Schools are responsible for the education of more than 90,000 kids including around 4,000 pupils who are immigrants.

Hispanic or Latinx students make up more than half of the group of pupils. In recent times, the city of Denver has witnessed an increase in the number of migrants.

In accordance with the lawsuit, around 43,000 individuals have entered the city from the southern border of the United States since the year 2023.

In the case, it was said that “parents across Denver enroll their children in public schools believing that while their children are at school, they will be educated and enriched without fear that the government will enforce immigration laws on those premises.”
